Chipotle is being sued by a New York customer after it allegedly hid the actual delivery costs and other expenses incurred to its customers when placing an order through its delivery service. John Dundon filed a class action lawsuit against the Mexican food chain Chipotle – contending that its ‘free delivery’ or ‘$1 delivery’ advertising is false.

The Chipotle Hidden Delivery Fees Class Action Lawsuit is filed in the United States District Court for the Northern District of New York. It is seeking to create a nationwide Class as well as a Class for New York residents who ordered through Chipotle’s food delivery service and ended up receiving additional hidden charges in their transaction.

Chipotle Mexican Grill on Tuesday agreed to pay $25 million to resolve criminal charges accusing the fast food company of serving tainted food from 2015 to 2018, sickening over 1,100 people in the United States, federal prosecutors said. The fine was the largest ever imposed in a food safety case, the Justice Department said in a statement.

Chipotle stockholders have filed a lawsuit against the restaurant chain alleging that company executives awarded themselves “hundreds of millions” of dollars just before stock prices tanked last year following multiple food poisoning outbreaks.

The complaint, filed by the city’s Department of Consumer and Worker Protection department, alleges Chipotle broke New York’s “ Fair Workweek Law ” by changing employees’ working hours without sufficient notice, not approving appropriate time off or additional play and other workweek scheduling violations.

The city said Chipotle violated the law close to 600,000 times at between 80 and 90 New York City locations over a roughly two year period between 2017 and 2019.

Under the Fair Work Week Law, which took effect in 2017, employers must give fast food workers “good faith estimates” of when and how long they’ll work, offer “predictable” work schedules and provide existing employees opportunities to pick up new shifts before hiring new employees.

In addition to violating the scheduling laws, Chipotle failed to comply with the city’s Paid Safe and Sick Leave law, according to the lawsuit. Between April 2014 and January 2020, Chipotle’s policy only allowed employees 24 hours of sick time, instead of the legal minimum of 40 hours, according to the complaint.
